Jaswant Singh,J(Oral) Father of the petitioner namely Balbir Singh was serving as Cane Surveyor with Morinda Co-operative Sugar Mills Ltd., when he went missing in November,1993. Mother of the petitioner namely Gurmeet Kaur was released pensionary benefits by treating said Balbir Singh as a civil dead person vide order dated 31.10.2003(P-2). Petitioner, in the present case, who is 43 years of age as of now is seeking a mandamus for employment on compassionate basis by Morinda Co-operative Sugar Mills Ltd.
It is highly debatable that even policy for compassionate appointment would be applicable to a Society i.e. Morinda Co-operative Sugar Mills Ltd., even if it is substantially controlled by the State Government. That apart there is delay of more than 10 years by 41 years old person raising the grievance.
After arguing for sometime and faced with the consequences of heavy costs, learned counsel for the petitioner prays for permission to withdraw the present writ petition.
