Mr. Balraj Singh Sidhu, Advocate, for the complainant. Amol Rattan Singh, J. (Oral) All the cases listed today have been taken up for hearing by way of video conferencing because of the situation existing due to the Covid-19 pandemic.

By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of regular bail, upon FIR no.70, dated 16.06.2020, having been registered at Police Station City Rampura, District Bathinda, alleging therein the commission of offences punishable under Sections 376 and 506 of the IPC.

Learned counsel for the petitioner submits that even as per the FIR, the petitioner and the prosecutrix were in a relationship for about 7 years and he was first alleged to have made physical relations with her 7 years prior to the lodging of the FIR.

He further submits, that in fact, upon her constant harassment, the petitioner also tried to commit suicide, in respect of which a DDR was also registered.

218) CRM-M-31158 of 2020 -2the factual position and upon further query submits that the petitioner is in custody for the past 6 months, with the trial still to commence. Learned counsel for the complainant obviously opposes the grant of bail to the petitioner for the grounds stated in the FIR. Having considered the matter, without making any comment on the actual merits of the case but keeping in view the aforesaid circumstances, the present petition is allowed, with the petitioner ordered to be enlarged on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the learned trial Court/CJM/Duty Magistrate concerned. 16.12.2020 (AMOL RATTAN SINGH) vcgarg JUDGE Whether reasoned/speaking: Yes
