On our asking, Ms.Palika Monga, learned Deputy Advocate General, Haryana, accepts notice on behalf of the respondents. Let three copies of the writ petition be supplied to learned State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution.
In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from the respondents at this stage. The petitioners claim that a part of their land has been acquired for the purpose of construction of drainage and road. Since the question as to whether the petitioners are entitled to compensation amount and if so, to what extent and whether such amount has been paid to them or not, are essentially the questions of fact for which they have served the authorities with a legal notice dated 25.05.2016 also, we dispose of this writ petition with a direction to the Land Acquisition Collector as well as the Deputy Commissioner, Sonepat, to ascertain the correct facts and determine the claim of petitioners in accordance with law within a period of four months from the date of receiving a certified copy of this order. Ordered accordingly.
