(ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 024 dated 13.03.2023 registered under Sections 376(2)(n), 377 and 506 IPC at Police Station Charkhi Dadri, District Charkhi Dadri. Learned counsel for the State has filed custody certificate dated 22.09.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 06 months and 01 day.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition, at this stage.
