In the present petition, the challenge is to the impugned order dated 06.05.2025 (Annexure P-10) by which, the petitioner has not been allowed to appear in final examination of the 4th semester of BBA Course by respondents-institute, which is causing prejudice to the petitioner. 2.
Learned counsel for the petitioner argues that the final examination of 4th semester of BBA were started in the April 2025 but the petitioner was not allowed to appear in the said examination, which act on the part of the respondents-institution is arbitrary and illegal, hence, the respondents-institution be directed to allow the petitioner to appear in the remaining examination of 4th semester of BBA. 3.
I have heard learned counsel for the petitioner and have gone through the case file with his able assistance. 4.
It may be noticed that learned counsel for the petitioner has conceded before this Court that two examinations of the 4th semester of BBA RIYA 2025.05.21 14:55 I attest to the accuracy and integrity of this document
CWP-14500-2025 has already been conducted and petitioner has not been allowed to appear in the earlier two examination of 4th semester of BBA course. That being the position, once, the examination of 4th semester of BBA course has already been started in the month of April, 2025 and two exams of the 4th semester of BBA course have already been missed by the petitioner, no ground is made out for any interference by this Court so as to allow the petitioner to appear in the remaining examination of 4th semester of BBA course. 5.
Further, the petitioner has not been allowed to appear in the 4th semester examination of BBA course by the respondents-institution on the ground that the petitioner has failed to attend even a single lecture of current semester of BBA course. The said fact has also been conceded by the learned counsel for the petitioner. Once, the petitioner has never studied and attended any single lecture of current semester of BBA course, the question of appearing in final examination of the 4th semester of BBA course does not arise. Even otherwise, the petitioner has also failed to prove that the impugned order dated 06.05.2025 (Annexure P-10) passed by the respondents-institution is contrary and illegal in any manner. Hence, n
