1. Petitioner No.1 in person submits that the loan account was outstanding of a sum of Rs.2.5 lacs which he had already deposited. In view thereof, the bank has closed the proceedings and has also declared his account as non-NPA. In view thereof, the SARFAESI proceedings stand closed, and the writ petition has therefore been rendered infructuous.

2. The petitioner however submits that he has been subjected to great harassment and that he has also suffered seriously on account of the actions of the respondents for which he has initiated criminal proceedings. However, he is not satisfied with the police investigation and wants this Court to interfere in this aspect.

3. This Court however believes that the correct remedy available to the petitioner is to approach the concerned competent court of criminal jurisdiction for initiating any proceedings which he may so want.
