M.M.S. BEDI, J. (ORAL) Petitioner claims that his brother Sanjeev Kumar is mentally retarded person. The petitioner has obtained an order from District Judge, Ambala by filing a petition under Section 50 read with Sections 51 to 54 of the Mental Health Act, 1987, for appointment as guardian of Sanjeev Kumar. The petitioner appears to have not impleaded State Bank of India, Model Town, Ambala City Branch as party in the said proceedings but through the instant writ petition has sought a direction to the State Bank of India to release the amount from the account of his father as his father has died living his brother Sanjeev Kumar as his sole legal heir. The petitioner has also submitted a request to the Manager, State Bank of India, Model Town, near Ambala Club, Ambala City in this context.

CWP-12068-2017 (O&M) This petition is disposed of with a direction to the Manager of the above said bank, which is a government instrumentality regulated by the Reserve Bank of India to consider the representation of the petitioner, Annexure P2, dated 5.4.2017, within a period of 15 days after the receipt of certified copy of the order, taking into consideration the mandate of the judgment Annexure P1 dated 6.9.2016, passed by the District Judge, Ambala. It will be the duty of the petitioner to communicate the certified copy of the order along with the copy of the writ petition to the Manager of the above said branch of State Bank of India. A further direction is issued that claim of the petitioner will be considered by passing a speaking order and petitioner will be communicated the order.
