On 18.07.2023, the following order was passed : "Learned counsel for the respondentNHAI submits that exercise to ascertain distance between petrol pump and highway could not be carried out because none of the party has supplied drawings and other documents which are required to ascertain distance between location of the petrol pump and highway.

The IOC-respondent No.1 is directed to supply drawing of the location, copy of the present writ petition as well as report of the Local Commissioner to NHAI so that necessary exercise may be completed. Adjourned to 17.08.2023.

Mr. Ashish Kapoor, learned counsel for the respondents submit that all the required documents would be supplied within 1 week from today.

The NHAI shall complete its exercise within 2 weeks thereafter. Neither learned counsel for NHAI nor IOC on the next date would take excuse of supply or non-supply of documents."

In compliance of aforesaid order, learned counsel for the NHAI submitted inspection report dated 01.08.2023, which is taken on record. Registry is directed to tag the same at appropriate place. 3.

Faced with this, learned counsel for the respondents-IOC submits that the case of the petitioner would be re-considered in the light of report submitted by NHAI and needful shall be done within 04 weeks from today.

In the wake of statement of learned counsel for the respondents-IOC, the petition stands disposed of. The petitioner would be at liberty to avail remedy as permissible by law, if petitioner feels dissatisfied with the further action of respondents-IOC.
