This petition has been filed under Section 528 of BNSS (Section 482 Cr.P.C) for quashing of order dated 25.10.2023 passed by ld. JMIC, Amritsar whereby the petitioner was declared proclaimed person in complaint bearing No. NACT-3874-2016 titled as Harjeet Singh Vs Roshan Lal. 2.

Learned counsel for the petitioner submits that the petitioner could not appear before the learned trial Court as he was unaware about the revival proceedings and remained under the bona fide belief that the dispute already stood amicable settled s the entire amount had been paid by him to the respondent in cash. Consequently, the learned trial Court initiated the proclamation proceedings and declared the petitioner as proclaimed person. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned order dated 25.10.2023 be set aside. This Court deems it appropriate to decide this case without issuing notice to the respondent.

I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the learned counsel for the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 25.10.2023 passed by ld. JMIC, Amritsar. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today at 10:00 A.M and moves an application for grant of regular bail, the trial Court is directed to consider and decide the same on the very same day.
