Jaswant Singh,J(Oral) Date of birth of the petitioner is 7.3.1988 and he is not eligible to apply for recruitment to the post of Constable as per Rule 5(1) of the Punjab Civil Service (General and Common Conditions of Service) Rules,1954 laying down the minimum age as on 1st January of the year in which the advertisement is published. By that rationale the petitioner is short of 2 months and seven days for being eligible for consideration for recruitment pursuant to the advertisement dated 31.5.2016(P-1). Grievance of the ptegitioner in the present petition was of fixing of date as 1st January,2016 as relevant date for determining the eligibility qua age. However, in the light of statutory provisions, learned counsel for the petitioner prays for permission to withdraw the present petition.
