**** Rakesh Kumar Jain, J. (Oral) The petitioner has challenged the appointment of respondent no.4 to the post of Lambardar of village Mughal Chak, Sub Tehsil Dhilwan, Tehsil and District Kapurthala by the Collector vide his order dated 31.03.2010, which has been upheld by the Commissioner, Jalandhar Divison, Jalandhar, vide his order dated 08.11.2011 and further by the Financial Commissioner vide his order dated 02.03.2016.

Counsel for the petitioner has submitted that respondent no.4 is the resident of village Mansurwal but it is not disputed that the boundaries of village Mughal Chak and village Mansurwal abut each other. The Collector, who is the appointing authority, has found respondent no.4 to be more meritorious than the petitioner and his choice has been accepted by the higher authorities.

Thus, there is hardly any reason for this Court to interfere in the

CWP No.12127 of 2017 [ 2 ] ***** appointment of respondent no.4 only on the ground that he belongs to the different village, though the said village is adjacent to the village where he has been appointed as Lambardar.

Consequently, the present petition is hereby dismissed being denuded of any merit.
