The petitioner seeks issuance of a writ in the nature of mandamus directing the respondents to release the pensionary benefits towards gratuity, leave encashment, commutation of pension, arrears of pay, GPF etc. 2.

As per reply filed by the State, the requisite benefits have already been released to the petitioner. In the reply, it has also been stated that in case any benefit still remains unpaid, the petitioner may represent for the same and that any such admissible relief would be released. 3.

Learned counsel representing the petitioner has today furnished some calculations in respect of the deficit payment, which is taken on record. 4.

Having regard to the aforestated position, wherein the retiral benefits are stated to have been released but the petitioner claims that some amount is still PANKAJ KAKKAR 2023.09.14 18:08 I attest to the accuracy and authenticity of this document

CWP-15725-2016 (O&M) ( 2 ) 2023:PHHC:121380 due, this Court deems appropriate that the instant petition be disposed of with liberty to the petitioner to move an appropriate representation/application delineating all the details of outstanding payments, if any, under different heads. In case, any such representation/application is filed by the petitioner, the respondents shall consider and dispose of the same expeditiously preferably within a period of 3 months from from the date of receipt of such representation/application. Further, if any amount is found to be outstanding and is to be paid to the petitioner, the same shall be paid within a period of two months thereafter alongwith interest @5% per annum. In case, the same is not paid within the stipulated period, the respondents shall be liable to pay interest @10% per annum.
