MAHESH GROVER, J. (Oral) In this writ petition the petitioner has challenged the action of the Gram Panchayat in issuing notices for auctioning the land of which the petitioner claimed to be in possession. It is not in dispute that proceedings under Section 11(2) of the Punjab Village Common Land and Regulation Act, 1961 initiated by the petitioner have been dismissed negating his claim to the suit property. The Gram Panchayat has been able to show its ownership on the basis of revenue record. No material contrary to it has been produced before us and, therefore, the petitioner cannot question the action of the Gram Panchayat in issuing notices to put the land to a beneficial use through an open auction.
No ground to interfere.
Dismissed with a direction to the petitioner to hand over possession to the Gram Panchayat positively within a period of three months from today. Since the crops would be standing, we direct the
CWP No.16697 of 2015 -2Deputy Commissioner concerned to appoint an administrator to manage the crops after they are sold and give the proceeds to the writ petitioner who might have sown these crops.
