CWP No.12186 of 2017 -1IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH CWP No.12186 of 2017 Date of Decision.31.05.2017 Harminder Singh ........Petitioner Vs Financial Commissioner, Revenue Punjab and others .....Respondents

Present:

Mr. HPS Ghuman, Advocate for the petitioner.

CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J.(ORAL) The petitioner is aggrieved of the impugned order dated 08.05.2017 (Annexure P-8) whereby the Financial Commissioner has admitted the ROR bearing No.1024 of 2016 at the instance of the private respondents and issued notice to the petitioner for 10.09.2017 and granted status quo order.

The petitioner ought to have approached the Financial Commissioner instead of coming directly to this Court as the revision petition, according to Mr. Ghuman, has been filed against the order dated 04.11.2016 (Annexure P-7) whereby the objection to application for dismissal of the partition proceedings on the basis of earlier partition has been rejected. In my view, no cause of action accrued in favour of the petitioner to approach this Court under Article 226 of the Constitution of India. However, the petitioner is at liberty to approach the Financial Commissioner for seeking vindication of his grievance. In case, any application is moved for vacation of status quo order, the same shall be disposed of expeditiously.
