( 2 ) RA-CR-139-2019 in FAO-6550-2012 and allowed and the review application in FAO-6550-2012 and CR-2285-2019 are preponed from 17.10.2023 and are taken on Board today itself. Mr. R.K.Aggarwal, Managing Director of Shalimar Estates Pvt. Ltd. and Mr. Paramjit Singh Ubbi, power of attorney holder of Reliance Retail Limited are present in person along with their respective counsel. Both the learned counsels have submitted that the matter has been amicably resolved amongst the parties and in respect of which a demand draft No.894622 dated 09.08.2023 of Rs.7,50,00,000/-, HDFC Bank, has been been brought today by Sh. Paramjit Singh Ubbi and the same has been handed over to learned counsel Mr. Nikhil Sabharwal, Advocate, who further passed on the said demand draft to Mr. R.K.Aggarwal, Managing Director of Shalimar Estates. A copy of the said demand draft has been supplied, and the same is taken on record.
Mr. R.K.Aggarwal, Managing Director of Shalimar Estates Pvt. Ltd. has stated before this Court that the matter stands fully compromised in terms of settlement and that with the payment of the said amount the terms of compromise stands fully complied with.
Both the learned counsels appearing on behalf of the parties submitted that in view of the above compromise, they may be permitted to withdraw review application in FAO-6550-2012 and CR-2285-2019. In view of the aforestated position, the instant review application in FAO-6550-2012 and CR-2285-2019 are disposed off as withdrawn having been compromised.
