Through instant petition preferred under Article 226 of the Constitution of India, petitioners have sought issuance of a writ in the nature of mandamus directing the respondents to grant the revised pension by including interim relief @ 5% of basic pension in terms of letter dated 16.02.2017 (P-9) issued by Government of Punjab, Department of Finance granting interim relief @ 5% of the basic pay/pension to the Punjab Govt. employees/pensioners w.e.f. 01.01.2017 as the petitioners are retirees from Privately Managed Recognized Aided Schools in the State of Punjab who are entitled for parity in the pay scale and dearness allowance of employees working under the Punjab Govt. and pensioners of the Punjab Govt. in terms of letter dated 31.03.1999 (P-2) and letter dated 09.09.2010 (P-8) along with interest @ 18% per annum. 2.

CWP No.10491 OF 2018 --2-- petitioners submits that though legal notice dated 05.02.2018 (P-11) was duly served upon the respondents but till date neither any response has been received nor any decision has been taken thereon. He further submits that petitioners feel satisfied in case direction is issued to respondents to consider and decide the afore-said legal notice (P-11), within a stipulated period. 3.

Accordingly, instant petition is disposed of with a direction to respondent No.2-Director, Public Instructions (SE), Punjab Vidya Bhawan, Ajitgarh Mohali to consider the case of the petitioners unfolded in legal notice dated 05.02.2018 (P-11) and to decide the same in accordance with Rules, regulations and instructions issued by government of Punjab from time to time, within a period of three months from the date of receipt of certified copy of this order.

However, if petitioners still feels aggrieved by any order of the aforesaid authority, they shall be at liberty to have recourse to the other remedies available under law as well as to approach this Court.
