AMIT RAWAL J. (Oral) The petitioner has sought the following relief:- "Civil writ petition under Articles 226 & 227 of the Constitution of India for issuance of a writ of Mandamus or any other appropriate writ, direction or order for directing the respondent no.1 to 4 to get demarcate the plot and also identify the boundaries of the plot bearing no.56/1, measuring 22 sq. yards, hadbast no.103 situated in village Kotala Dhana, Tehsil Samrala, District Ludhiana allotted to the petitioner vide Conveyance deed dated 12.10.1976 (Annexure P-1) issued by respondent no.4 with specific boundaries and hand over the possession of the plot as per Conveyance Deed to the petitioner;

AND Further direction may also be issued to the respondent no.2 to Savita 2017.02.07 10:27 I attest to the accuracy and integrity of this document High Court Chandigarh

CWP No.1223 of 2017 {2} take appropriate action on the representation on the representation dated 19.08.2016 (Annexure P-10) filed by the petitioner for demarcation of the plot allotted to the petitioner vide conveyance deed dated 12.10.1976;

AND Any other appropriate, writ, direction or order to which the petitioner is entitled may also be passed with all consequential and relief's."

It is a disputed question of fact and law, cannot be adjudicated in the present writ petition. Liberty is granted to the petitioner to avail remedy under Section 9 of the Code of Civil Procedure as he has to get demarcation by leading direct and cogent evidence. The writ petition stands disposed of, in the aforementioned terms.
