ARUN PALLI, J (Oral) A certiorari is prayed for to quash the impugned letter dated 29.05.2024 (P-1), vide which the Chandigarh Housing Board (Board) has rejected the application moved by the respondent No.4 (Shiv Kumar), seeking 'No Objection Certificate' (NOC) for sale of lease rights in dwelling unit No.3307, Sector 47-D, Chandigarh (EWS Category). Apparently, the request of respondent No.4 (Shiv Kumar) was rejected by the Board as there was third party interest involved in the transaction.

Having argued the matter at some length, learned counsel for the petitioner submits that he be permitted to withdraw the petition so as to enable the petitioner to move the respondent Board qua his concerns/grievances by submitting a representation appended therewith all necessary documents.

Served with the advance copy of the petition, Ms. Ruchi Sekhri, Advocate, is present in Court on behalf of the respondent-U.T. Chandigarh. At the outset, on instructions, she submits that in the event any such representation is moved, the same shall be taken cognizance of by the respondent Board. And appropriate orders, in accordance with law, shall be passed thereon within a period of eight weeks therefrom.
