  **** HARNARESH SINGH GILL, J.(Oral) Prayer in this petition is for issuance of a writ in the nature of Mandamus directing the respondents to allow the petitioner to join as Eligible Extension Lecturer, Botany, against unmet workload and vacant sanctioned post in Government College for Women, Sector-14, Gurugram.

Learned counsel for the petitioner submits that, in the year 2013, the petitioner was appointed as Extension Lecturer, Botany and had worked as such till May, 2017; that, at that time, the petitioner was not having Ph.D. Degree; that the petitioner completed Ph.D. on 08.02.2020 from OPJS, University, Churu, Rajasthan; that the Government of Haryana issued policy dated 04.03.2020 (Annexure P-4), vide which the eligible displaced candidates were ordered to be adjusted against unmet workload and vacancy available and that the petitioner is duly covered under the said policy, being one of the displaced Eligible Extension Lecturers.

CWP-16417-2020 (O&M) -2Learned counsel for the petitioner further submits that the petitioner moved a representation dated 22.08.2020 to the respondents, but to no avail.

On the other hand, learned State counsel does not dispute the aforesaid factual position. He, however, submits that if the petitioner moves a fresh representation, the same can be considered as per the terms and conditions of the policy dated 04.03.2020 (Annexure P-4). Learned counsel for the petitioner has no objection to the aforesaid limited prayer made by the learned State counsel. In view of the above, the petitioner is hereby directed to file a fresh representation before respondent No.2 for redressal of his grievance (as per the policy dated 04.03.2020), within 15 days from the receipt of the certified copy of this order. On his doing so, respondent No.2-Director General, Higher Education, Haryana, is directed to decide the same as per law, within eight weeks thereafter. Disposed of in the above terms.
