HARSIMRAN SINGH SETHI, J.(ORAL) The present petition has been filed by the petitioner with the averments that the petitioner, while in service, has acquired a disability to the extent of 95%, which fact has already been certified by the Medical Board of Post Graduate Institute of Medical Sciences, Rohtak. Learned counsel for the petitioner submits that keeping in view the provisions of Section 47 of The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 read with instructions issued by the Government of Haryana dated 19.09.2011 (Annexure P-6), the petitioner is entitled for the benefits, as envisaged under the said Act coupled with the instructions dated 19.09.2011 (Annexure P-6).
Learned counsel for the petitioner further submits that the petitioner has already submitted a representation on 02.07.2020 (Annexure P-7) before respondent No.2 and the petitioner will be satisfied at this stage NARESH KUMAR 2020.10.06 19:41 I attest to the accuracy and integrity of this document Chandigarh
CWP-16340-2020 in case, a time bound direction is issued to respondent No.2 to decide the said representation by passing an appropriate speaking order. Notice of motion.
Ms. Rajni Gupta, learned Additional Advocate General, Haryana, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of the respondents-State.
Learned counsel for the respondents raises no objection for deciding the representation of the petitioner dated 02.07.2020 (Annexure P7) in a time bound manner. Without commenting upon the merits of the case or about the entitlement of the petitioner for the relief which has been claimed by her in the representation dated 02.07.2020 (Annexure P-7), the present writ petition is disposed of with a direction to respondent No.2 to decide the representation dated 02.07.2020 (Annexure P-7) within a period of six weeks from the receipt of copy of this order. The decision upon the representation of the petitioner, as directed by this Court, will be taken by the respondents in view of the Section 47 of The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 as well as instructions dated 19.09.2011 (Annexure P-6).
