JASWANT SINGH, J (ORAL) Petitioner was engaged as a part time Sweeper on 21.10.1997 with the office of Executive Engineer, Golewala Drainage Division, Canal Colony, Ferozepur Cantt-respondent No.4. Her services are alleged to have been illegally terminated on 29.4.1999.
The petitioner raised an industrial dispute. Learned Labour Court, Bathinda vide its award dated 18.2.2005 (P.1) ordered the reinstatement and continuity of service with 40% of back wages from the date of demand notice i.e 03.2.2000. The Irrigation Department challenged the award before this Court and the writ petition was dismissed as also the SLP filed by the State. The petitioner, thus, was re-engaged on part time basis vide order dated 03.4.2006.
Prayer is for issuance of directions to the respondents to regularize the service of the petitioner against the available post in the light of the earlier Policy dated 04.3.1999 (P.5) governing the regularization of part time employees.
CWP No.15841 of 2016 #2# It is apparent that the said Policy was a one time Policy and not to be kept alive for ever.
