The petitioner has approached this Court under Articles 226/227 of the Constitution of India, seeking a writ of Mandamus directing respondent No. 1 to take over the physical possession of the mortgaged property i.e. Hotel KC Cross, Sector-10, Panchkula mortgaged by M/s Walia Traders Limited, Chandigarh, under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

After arguing for sometime, learned counsel for the petitioner submitted that he may be allowed to withdraw the present writ petition, with liberty to file fresh one on the same cause of action by impleading the borrower/mortgagor as necessary party.
