( ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.138 dated 07.07.2021 under Sections 363, 366-A, 120-B IPC registered at Police Station Dirba, District Sangrur.

Counsel for the petitioner would contend that the petitioner has been falsely implicated in the said matter. It is further contended that under the statement of Lakhwinder Singh-complainant, the instant FIR has been registered with the allegation that one Arshdeep Singh and his friends have abducted the daughter of the complainant on the pretext of arranging her marriage with Arshdeep Singh. It is alleged that it came to the knowledge of the petitioner that the prosecutrix and Arshdeep had moved an application for protection of life and liberty from their parents, which application had been marked to SP(H), Mansa and is pending inquiry. It is submitted that the petititoner has been in custody since 07.07.2021 and the matter stands POONAM BHATT 2021.09.10 18:07 I attest to the accuracy and integrity of this document

CRM-M No.36581 of 2021 -2investigated and challan has been presented, therefore, prays for concession of bail to the petitioner.

Whereas, counsel for the respondent-State would oppose grant of regular bail to the petitioner by contending that the petitioner had facilitated the occurrence.

I have heard counsel for the parties and in view of the fact that only role alleged is that the petitioner had facilitated Arshdeep Singh in taking away the daughter of the complainant and that no overt action had been attributed to him and that the matter stands investigated and challan has been presented and the fact that trial is likely to take some time to conclude, this Court deem it appropriate to allow regular bail to the petitioner. The instant petition is allowed and the petitioner is directed to be released on regular bail on adequate execution of personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
