(ORAL) Prayer of the petitioners in the present writ petition is that they are entitled for the grant of wages by including 5% amount over and above the DC rates as they have more than five years of experience in service. In this regard, the reliance is being placed on the letter dated 15.05.2018 (Annexure P-2).

Learned counsel for the petitioners submits that the grievance, which is being raised in the present writ petition, has already been raised before the Principal Medical Officer, Civil Hospital, Panchkula, vide representation dated 14.05.2019 (Annexure P-3), which representation has already been forwarded to the competent authority, but no final decision has been taken so far and the petitioners will be NARESH KUMAR 2020.12.04 16:40 I attest to the accuracy and integrity of this document Chandigarh

CWP-16794-2020 -2satisfied, at this stage, in case a time bound direction is issued to respondent No.2 i.e. the Chief Medical Officer, Civil Hospital, Panchkula, to decide their claim with regard to grant of wages @ 5% over and above the DC rates, as proposed by the Deputy Commissioner, Panchkula, vide letter dated 15.05.2018 (Annexure P-2).

Learned State counsel submits that the decision upon the representation dated 14.05.2019 (Annexure P-3) filed by the petitioners, claiming the higher wages, will be taken by respondent No.2 within a period of two months, by passing an appropriate speaking order. In view of the above, without expressing any opinion on the merits of the case or the claim being made by the petitioners, respondent No.2 is directed to consider and decide the claim of the petitioners for the grant of wages by including 5% amount over and above the DC rates, by passing a speaking order within a period of two months from the date of receipt of a certified copy of this order.

Present writ petition stands disposed of.
