Petitioner-Committee has preferred this writ petition seeking a direction to official respondents to withdraw the police personnel deployed at the premises of the petitioner in Mohalla Gobindgarh, Jalandhar city. It has been urged before the court that petitioner-Committee is entitled to practice its religion and it cannot be obstructed by the respondents. He has referred to certain photographs to contend that police personnel are deployed outside the premises. In the affidavit filed on behalf of the police, it has been stated that petitioner-Committee had purchased a house in Mohalla Gobindgarh, Jalandhar in the name of the Committee. Initially, it was stated that an office would be opened therein. However, an Idol was installed in the premises on the intervening night of 29/30 April, 2017.

Residents of the locality objected and called the police control room. In order to prevent any breach of law and order, police personnel were deployed. On due consideration of the matter, this petition is disposed of Ajay Kumar 2017.12.

CWP No. 12358 of 2017 apprehension of breach of law and order. The matter needs to be examined by the Deputy Commissioner as well as Commissioner, Municipal Corporation. In case it is felt that 'residential premises' is sought to be converted into religious place, they would act as per law. In case any action of the petitioner-Committee is found to be in violation of any existing instructions/policy, the authorities shall be at liberty to enforce the same after following due procedure.
