(ORAL) In the present writ petition the petitioner has challenged the charge-sheet dated 31.05.2016 (Annexure P-8) on the ground that the disciplinary proceedings could not be continued after retirement. Written statement filed on behalf of respondents No.1, 3 and 4 today in the Court is taken on record and a copy thereof has been supplied to opposite counsel.

This Court while issuing notice of motion on 31.05.2017 directed that the inquiry proceedings should continue, but the final order will not be passed.

CWP-12364-2017 (O&M) -2Today counsel for the petitioner states that inquiry proceedings have already been concluded by the department, but in view of the order dated 31.05.2017 the final order is not being passed and therefore he prays for vacation of the said order. Counsel for the petitioner states that petitioner be allowed to withdraw the present writ petition but with a direction to the respondent(s) to pass the appropriate orders on the disciplinary proceedings initiated against the petitioner within a time bound manner. The request made by the counsel for the petitioner is genuine. Writ petition is dismissed as withdrawn.

Competent authority will be at liberty to pass the appropriate orders on the disciplinary proceedings, which was conducted against the petitioner and the final order be passed within a period of two months from the date of receipt of a certified copy of this order. It is clarified that in case after passing of the said order, the petitioner will become entitled for any benefit, the same shall be released to him expeditiously thereafter, preferably, within a period of four months.
