At the time of issuance of notice of motion, petitioner had contended that he and his paternal uncle were original allottees of the land. They have sold the land through GPA for valuable consideration to bona fide purchasers. According to learned counsel, case of the petitioner does not fall within the ambit of para 14 of the judgment in CWP No. 22826 of 2012 decided on 20.12.2012. However, GPA/vendees were harassing the petitioner and his paternal uncle. This court had issued notice to Vigilance Department.
Learned State counsel, on instructions from Major Singh, SI, Vigilance Bureau, Nawanshahar, who is present in court, today submits that petitioner is not being harassed. He is not an accused but has been cited only as a witness.
In view of statement made by learned State counsel, no cause of action survives in this petition. Disposed of. Petitioner would, however, be at liberty to seek his remedy in case any fresh cause of action arises.
