**** RITU BAHRI , J. (Oral) The precise prayer of the petitioner is to step-up and reffix his pay by giving him notional benefits, gratuity etc from the date Sht. T.R. Atal has been promoted to the post of Circle Supdt due to reserve category, in view of the judgment of Hon'ble the Suhpreme Court of India in 'R.K. Sabherwal and others v. State of Punjab and other 1995(2) S.C.T 646' and judgment passed by this Court in Charan Dass vs. State of Haryana, passed in CWP No. 5956 of 2008, decided on 18.11.2008..

The petitioner has submitted representations (P-1 to P-5) and legal notice dated 20.04.2015 in this regard, but no decision has been taken thereon.

In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to respondents to consider and decide the representations/legal notice (P-1 to P-6) of the petitioner by passing a speaking order expeditiously, in accordance with law, preferably, within a period of three months from the date of receipt of certified copy of this order.
