Petitioner - Harinder Kaur, has filed the present writ petition, for seeking quashing of the notice uploaded on the website on 30.07.2020 (Annexure P-12), and also, for quashing of the revised provisional merit list uploaded on website on 02.09.2020 (Annexure P-14), whereby, selection of the petitioner for the post of Resource Teacher, has been cancelled by the respondents, and private respondent No.5 - Ms. Kanta Devi, has been selected.

Counsel appearing for the respondents point out that as per reply of respondents No.1 to 3, the provisional merit does not exist as on date, because the final merit list of the candidates for the post of Resource Teacher (Special Education-HI), under the Samagra Shiksha, Chandigarh, has already been published, and therein, the petitioner stands at serial No.2 JAWALA RAM 2024.05.13 18:20 I attest to the accuracy and integrity of this document
CWP-16666-2020 - 2 - and private respondent No.4, stands at serial No.1, in the final merit list. Thus, counsel submits that in the back-drop of the abovementioned circumstances, the relief claimed in the present writ petition has been rendered infructuous, and in case, any grouse still exists, same can again be expressed by filing a separate writ petition by challenging the final merit list.

Learned counsel for the petitioner is not in a position to controvert the facts pleaded in the written statement, and the document of final merit list appended with it. However, he prays for grant of liberty to challenge the said selection along with final merit list afresh by filing the appropriate petition.

Present writ petition is dismissed as having been rendered infructuous. However, liberty is granted to the petitioner to challenge the final merit list in accordance with law.
