The present Regular Second Appeal has been preferred against the judgment and decree dated 30.11.2004 passed by learned Additional District Judge, Kurukshetra, whereby, appeal filed by the respondents against the judgment and decree dated 30.04.2004 passed by learned Additional Civil Judge (Senior Division), Kurukshetra, was allowed. 2.

Learned counsel for the appellant submits that the present appeal has been rendered infructuous, as the appellant has already retired from service and the issue involved in the present appeal pertains to the change of date of birth.
