For the reasons stated in the application, the same is allowed and delay of 316 days in refiling the revision petition stands condoned. CR-4237-2019 2.
The defendant No.1 assails the correctness of an interlocutory order passed by the trial Court, while dismissing his objections to the report submitted for the preparation of final decree for partition. The petitioner claims that he is in occupation of the premises as a tenant, though, he has also purchased a portion of the joint property. 3.
The trial Court, while dismissing the objection petition, has held that in a suit for possession by way of his ejectment, the Court has already passed a decree to the effect that he is no longer a tenant. 4.
