The jurisdiction of this Court has been invoked under Article 226 of the Constitution of India, inter alia, for issuing a writ of mandamus directing the respondents to release the retiral dues of the petitioner along with interest and to grant him financial upgradation under ACP Rules w.e.f. 2022 and to refix his pay.

During the course of hearing, a copy of the order dated 26.05.2026 has been produced which is taken on record as Mark 'A'. It has been averred in the letter (Mark 'A') that some of the retiral benefits have been paid/release to the petitioner. Para 2 of the said letter is reproduced hereunder:- "2.
It is further submitted that upon receipt of the approved case of pay fixation in respect of said petitioner from the Sainik & Ardh Sainik Welfare Department, Panchkula vide Memo No 12/22/2024-2D1/723 dated 11 May 2026, the following retiral benefits have already been paid/released to the petitioner by Drawing and Disbursing officer, District Sainik & Ardh Sainik Welfare Office, Rohtak :- (a) Arrears of amount of Rs 1,93,839/- on fixation of pay on grant of 2nd ACP and promotion from Clerk to Head Clerk for the entitled period have also been paid to the petitioner on 22 May 2026 (Copy attached) (b) Leave encashment payment of amount of Rs 6,68,340/- paid on 20 May 2026 to the petitioner (Copy attached). V VISHAL SHONKAR 2026.06.
129-CWP-14912-2026 - 2 - (c) GIS amount of Rs 18,591/-has been paid to the petitioner on 22 May 2026 (Copy attached).

Further, it is submitted that the case of the petitioner for pensionary benefits including Pension, Retirement Gratuity, Commutation of Pension, Final withdrawal of General Provident Fund and other admissible retiral benefits have been submitted on the ODMS portal of Office of the Principal Accountant General, Haryana Office Portal on 20 May 2026 (Copy attached)." (3).
The second prayer qua financial upgradation under ACP Rules, 2016 and re-fixation of pay is concerned, Wing Commander Ms. Gauriha Suhag, who is present in Court, submits that the said relief has also been considered and granted to the petitioner.

In the light of the above, nothing survives in the present writ petition and the same is accordingly disposed of as having become infructuous. (5).
Disposed of as infructuous.
