Prayer made in the present petition is for setting aside the result dated 25.06.2014 qua the ESM (BCA) category for the post of Forest Guard on the ground that the petitioner was not considered under the said category but was under ESM (General), to which learned State counsel makes a reference to para 5 and 6 of the written statement, relevant extract thereof reads thus:- "5. At the time of interview the applicant did not produce the caste certificate (BC-A) issued by the competent authority which was essential for qualifying in the ESM (BC-A) category. It was pointed out in the meeting of DSC members on 12.12.
2013 that in many cases the candidates failed to produce at the scheduled date of interview the original certificates such as mark sheet, domicile certificate, experience certificate, caste certificate, gradation certificate for outstanding sports persons, and civil employment certificates for ESM etc. issued by competent authority. The candidates pledged to produce original certificates after the interview for consideration. The DSC decided that the candidates may be allowed to submit the certificates in original at the earliest but not later than 28.02.2014 at the venue of interview or at the office of CCFcum- Chairman DSC, Van Bhawan, Panchkula. It was clarified to the candidates that any certificates submitted after the closing date (28.2.2014) will not be considered. The notice to this effect was issued on 12.12.
2013 and posted at the venue and the same HAMANT 2024.10.
CWP-17716-2014 was informed to the candidates in interview room also by the members. It is further submitted that the petitioner neither submitted the caste certificate at the time of interview nor before the closing date i.e. 28.02.2014. The copy of the notice dated 12.12.2013 is enclosed herewith as Annexure- R 1.
6. ...... The cut off marks in matriculation for ESM (General) was fixed and advertised as 58% for qualifying for interview call. The applicant secured 55.11% in matriculation which was the basis for qualifying for interview call. The applicant secured 55.11% marks in matriculation and 28 marks in interview. The total marks secured by the applicant was 83.11 (55.11+28). The last candidate in ESM (General) category who was recommended for appointment secured 98.22 marks. So the applicant cannot be selected for appointment. It is further submitted that due to this reason the applicant was declared not eligible for selection process and his candidature was rejected as 'not eligible' for being 'below cut off marks' as recorded in the detailed result published on 11.7.2014. (Annexure P-11)." 2.
