The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking quashing of FIR No. 240 dated 06.05.2025 under Sections 127(6) of BNS, 2023 registered at Police Station Camp Palwal, District Palwal.

Learned counsel for the petitioner contends that the petitioners are major and have solemnized marriage on 02.05.2025 at Kachari, Bulandshahar, Uttar Pradesh which was registered on 05.05.2025. However, with regard to aforesaid FIR, it is stated that petitioner No.2 Aniya is not missing and being a major, she is residing as wife of petitioner No.1 with him. He further contends that the petitioners have also been granted protection by the High Court of Uttar Pradesh at Allahabad vide order dated 15.05.2025. Learned counsel for the petitioner further contends that petitioner no.2 has also made a representation dated 05.05.2025 (Annexure P-3) to the police authorities which is not being considered.  3.

Keeping in view the facts and circumstances of the case and without commenting upon the merits of the case, the Superintendent of Police, Palwal, is directed to decide the representation dated 05.05.2025 (Annexure P-3) within a period of 03 weeks from the date of passing of this order, by passing a speaking order.
