*** RAMESHWAR SINGH MALIK, J. (Oral) In compliance of the order dated 27.1.2015 passed by this Court, Sarv Sh. S.K.Bansal, Superintending Engineer 'OP', Uttar Haryana Bijli Vitran Nigam Limited, Kaithal-respondent No.4 and Geetu Ram, Executive Engineer, Uttar Haryana Bijli Vitran Nigam Limited, Pundri, District Kaithalrespondent No.5 are present in the Court. Learned counsel for the respondents, on instructions from Sh. S.K.Bansal, Superintending Engineer 'OP', Uttar Haryana Bijli Vitran Nigam Limited, Kaithal respondent No.4, submits that petitioners will be allowed to join their services within a period of one week from today. He further submits that let the petitioners report for duty on 18.2.2014 at 10 A.M., in the office of the Executive Engineer, Uttar Haryana Bijli Vitran Nigam Limited, Pundri, District Kaithal-respondent No.5.
Faced with the above, learned counsel for the petitioners also fairly states that let the present writ petition be disposed of, in view of the statement made by learned counsel for the respondents. AMIT KUMAR 2015.02.
CWP No. 3797 of 2011 (O&M) Ordered accordingly.
However, it is made clear that the outsourcing policy which was not prevailing at the time of removal of the petitioners from service, will not be applicable qua the petitioners and they shall be allowed to join duty on the same terms and conditions on which they had earlier been working. It is further clarified that except the arrears of salary for the period they remained out of service, petitioners will be entitled for all other service benefits.
Disposed of, accordingly.
