The petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.38 dated 25.05.2024 under Section 420 of the Indian Penal Code, 1860, registered at Police Station Balachaur, District Shaheed Bhagat Singh Nagar. 2.

On 18.07.2024, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation. 3.

A demand draft dated 14.10.2024 drawn at Punjab National Bank amounting to Rs.1.00 lac has been handed over to learned counsel for the complainant in Court today in compliance of order dated 24.06.2024 passed by a coordinate Bench of this Court. Learned State counsel, on instructions from ASI Dharam Chand, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation. 5.

Learned counsel for the complainant submits that although demand draft in the sum of Rs.1.00 lac has been received by him, however, the petitioner still owes him the remaining amount in the sum of Rs.6,57,000/-.

In view of the above, the petition is allowed and interim order dated 18.07.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
