The petitioner has no legal right to approach this Court for payment of upgradation charges on the only ground that in a writ petition filed by some other aggrieved person in CWP No.2052 of 2011, this Court had granted such a direction. The entitlement to the upgradation charges was for the year 2009-10 and such a right cannot sustain to the petitioners at this length of time after six years. The mere fact that the writ petition which was filed in the year 2011 was allowed in favour of the petitioner cannot give a cause of action for these petitioners to approach this Court at their own time. 2.
The petitioners are guilty of laches and the writ petition is dismissed.
