The petitioner has approached this Court seeking issuance of directions to transfer the investigation pertaining to FIR No.73 dated 17.6.2021 registered at Police Station Tapa Mandi, District Barnala under Sections 21 and 25 of Narcotic Drugs & Psychotropic Substances Act, wherein the son of petitioner has been involved as an accused.

Learned counsel for the petitioner submits that the petitioner's son has been falsely implicated and was first picked up from his home and was later on involved in the case and that the entire incident of the petitioner's son being picked up by the police happens to be recorded in CCTV camera installed outside petitioner's house.

Mr. Harbir Sandhu, AAG, Punjab, upon whom an advance copy of petition had already been served, has informed that report under Section 173 Cr.P.C. has not been presented in the Court yet.

Having heard the learned counsel for the petitioner and without commenting anything as regards the veracity of averments made in the petition and while keeping in view that the matter is still under investigation, the instant petition is disposed of with a direction to respondent No.4-Senior Superintendent of Police, Barnala, District Barnala to ensure that the investigation in the FIR in question is conducted meticulously and while conducting the same, the CCTV footage (Annexure P-1) be also considered and representation dated 24.6.2021 (Annexure P-6) (although addressed to Director General of Police, Punjab, Chandigarh) is examined and disposed off expeditiously in accordance with law.

A copy of this order alongwith copy of representation dated 24.6.2021 (Annexure P-6) be sent to respondent No.4-Senior Superintendent of Police, Barnala, District Barnala for necessary compliance. 6.

The petitioner is directed to furnish a copy of the CD, which has been annexed as Annexure P-1, to respondent No.4 so as to enable him to get the same examined. The petitioner would also be at liberty to file a fresh detailed representation, in case need be.
