(ORAL) The petitioner has filed the present petition under Section 482 Cr.P.C., for quashing of FIR No. 352 dated 10.08.2023 (Annexure P1) registered under Sections 376, 328, 365, 506 IPC at Police Station SGM Nagar (Sanjay Gandhi Memorial Nagar), Faridabad District Faridabad (Haryana) and all consequential proceedings arising therefrom, on the basis of Compromise dated 24.05.2024 (Annexure P-5) effected between the parties.
Vakalatnama filed on behalf of respondent No.2 in Court today is taken on record.
Pursuant to the order 25.06.2024 passed by a Coordinate Bench of this Court, the parties appeared before the learned Additional DIVYANSHI 2024.08.06 11:11 I attest to the accuracy and integrity of this document
CRM-M-30514-2024 (O&M) -2District & Sessions Judge, Faridabad, to get their statements recorded. Learned Additional District & Sessions Judge, Faridabad has submitted her report along with statements of the parties vide letter dated 26.07.2024 duly forwarded by the learned District & Sessions Judge, Faridabad.
A perusal of the said report shows that in sub-para (v), it is stated as under:- "that the compromise stated to have been arrived at, between the parties, does not seem to be genuine, voluntary and without any coercion or underinfluence. That this was a case of rape committed upon a very young girl, aged 19 years. The petitioner/accused was not known to the victim, as such, there was no chance of genuine compromise between them (i.e. the petitioner/accused and the victim). She seems to be under pressure of her family or for other extraneous consideration, which is not just and proper please." In view of the above, learned counsel for the petitioner submits that he does not press the present petition, at this stage, and the same may be dismissed, as not pressed.
