The petitioner has approached this Court under Article 226 of the Constitution of India, seeking a direction to respondent No. 2 to restrain respondent No. 4 from raising construction over Plot No. 988-A, Sector-21D, Faridabad.

After arguing for some time, learned counsel for the petitioner submitted that in view of the factual matrix of the case which may require evidence, he may be allowed to withdraw the instant petition, with liberty to the petitioner to avail the alternative remedy by filing a civil suit. 3.
Dismissed as withdrawn.

It shall, however, be open to the petitioner to take recourse to the remedies, as may be available to him, in accordance with law.
