HARSIMRAN SINGH SETHI, J.(ORAL) In the present case, the challenge is to the order dated 24.07.2020 (Annexure P-1), which has been passed by respondent No.3the Commissioner of Police, Ludhiana by which the recommendations have been made to the District Magistrate, Ludhiana in respect of the application filed by the petitioner seeking 8 weeks of parole. Learned counsel for the petitioner concedes that this is only a recommendation and the actual order, whether to allow or decline the said request of parole is to be passed by the District Magistrate, Ludhiana on his application. Learned counsel for the petitioner submits that the petitioner will be satisfied, in case a direction is issued to the District Magistrate, Ludhiana i.e. respondent No.2 to pass appropriate order on the application of the petitioner dated 27.07.2020 (Annexure P-2) seeking parole of 8 weeks.

CRWP-8060-2020 Mr. Sandeep Singh Deol, learned Deputy Advocate General, Punjab, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of the respondents.

Learned counsel for the respondents submits that the State has no objection in case, a direction is issued to District Magistrate, Ludhiana i.e. respondent No.2 to pass appropriate order on the request of the petitioner by which the petitioner had applied for the grant of 8 weeks parole.

Without commenting upon the merits of the case or about the entitlement of the petitioner for the relief which has been claimed by him in the application dated 27.07.2020 (Annexure P-2), the present writ petition is disposed of and the respondent No.2-District Magistrate, Ludhiana is directed to pass an appropriate order on the request of the petitioner for the grant of 8 weeks parole within a period of four weeks from the receipt of copy of this order.
