RAJIV NARAIN RAINA, J.(Oral) The impleadment of the legal representatives and legal heirs of the 11th appellant who has passed away will not turn the tide of the declaration of law by the Supreme Court in Singh Ram (D) through L.Rs. vs. Sheo Ram and others, 2014(4) RCR (Civil) 179 that only a mortgage is a mortgage and will remain always open to redemption. In view of the Punjab & Haryana High Court Amendment to the High Court Rules & Orders in Order 22 Rule 3 impleading LRs in such a situation is not necessary as it will not affect their rights which have already been determined by the Final Court. Nothing further remains to be examined.
The appeal stands dismissed.
