Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.160 dated 19.05.2015 under Sections 302, 201, 120-B, 364, 202 and 34 IPC, registered at Police Station Sadar Jind.
Notice of motion was issued. Learned State counsel appeared, filed reply and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that earlier the petitioner was on bail but he absented from the Court proceedings on 03.04.2019. CRM No.M-28549 of 2019 -2Court on 25.04.2019 and since then, he is in custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, the present petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the trial Court/Duty Magistrate, further subject to the condition that petitioner shall deposit of `5000/- with the District Legal Services Authority, Jind.
