G.S.SANDHAWALIA, J. (Oral) The petitioner seeks directions to the respondents to release of the entire retiral benefits to the petitioner qua leave encashment as per revised pay scale w.e.f. 01.01.2006 alongwith interest as claimed in the representation dated 04.07.2016 (Annexure P-7). Counsel for the petitioner submits that the petitioner has retired from the post of Superintendent on 31.10.2015 from the establishment of respondents no. 4 and 5. However, his dues of leave encashment have not been released, though he is entitled to the same and in spite of personal requests, the said respondents are sitting upon the same. Reference is made to the representations dated 05.04.2016 and 04.07.2016 (Annexures P-6 and P-7).

Counsel accordingly submits that he would be satisfied if time bound decision is taken by respondent no. 4 on the said representations.

CWP No. 16290 of 2016 opinion that there is no need to call upon the respondents to file reply. Accordingly, without commenting on the merits of the case and entitlement of the petitioner, the present writ petition is disposed of with direction to respondent no. 4 to decide the representations dated 05.04.2016 and 04.07.2016 (Annexures P-6 and P-7) within a period of 2 months from the date of receipt of certified copy of the order. In case the petitioner is held entitled for the benefits, same be also released to him within a period of one month thereafter.
