In this writ petition filed under Articles 226/227 of the Constitution of India, the petitioners have prayed for issuance of a writ in the nature of mandamus directing respondent No.2 to cancel the license dated 10.12.2012 issued to respondent No.4.

Respondent No.4 is a Real Estate Company (Annexure P-1). It had been granted licence No.120 of 2012 dated 10.12.2012 (Annexure P-2) by respondent No.2 to develop a residential plotted colony on the land situated in the revenue estate of village Assandh, Sector 10, Assandh, District Karnal. Under the said license, respondent No.4 launched the project in the name of 'Prime City Assandh'. As per the list, Annexure P-3, the petitioners and others applied for the allotment of plots. The plots were to be allotted as per the site plan, Annexure P-4. However, respondent No.4 had not developed the said project as is clear from the photographs, Gurbachan Singh 2018.05.10 12:54 I attest to the accuracy and integrity of this document

CWP-11008-2018 -2Annexure P-5. Accordingly, the petitioners moved a representation dated 11.4.2018 (Annexure P-6) to respondent No.4 for cancelling the license of respondent No.4, but no response has been received till date. Hence, the present writ petition.

Learned counsel for the petitioners submitted that for the relief claimed in the writ petition, the petitioners have sent a representation dated 11.4.2018 (Annexure P-6) to respondent No.2, but no action has so far been taken thereon.

After hearing learned counsel for the petitioners, perusing the present petition and without expressing any opinion on the merits of the case, we dispose of the present petition by directing respondent No.2 to take a decision on the representation dated 11.4.2018 (Annexure P-6), in accordance with law by passing a speaking order and after affording an opportunity of hearing to the petitioners and respondent No.4 within a period of three months from the date of receipt of the certified copy of the order.
