(ORAL) This is the third petition filed under Section 439 of Cr.P.C. for grant of interim bail to the petitioner in case FIR No. 276 dated 4.10.2017 under Sections 307, 326, 452, 506, 148, 149, 302, 201 and 323 IPC, registered at Police Station Daba, District Ludhiana, on medical grounds, for a period of four months, as the petitioner is not in a position to surrender himself as per the orders of this Court passed in CRM No. 17123 of 2022 decided on 26.4.2022. Learned State counsel affirms the factum regarding admission of the petitioner in the hospital.
Given above, the interim bail granted to the petitioner is extended till 16.8.2022.
It is clarified that the petitioner shall surrender before the Court concerned from where he was released on 16.8.2022 at 10:00 a.m. If after his surrender, the concerned Jail Superintendent finds his condition not to be worth ASHWANI KUMAR 2022.07.30 10:55 I attest to the accuracy and integrity of this document
CRM-M-32823 of 2022 -2keeping in jail, then he shall issue certificate to that effect immediately to the petitioner to file fresh application for bail. No application for further extension shall be considered. However, the petitioner is at liberty to file fresh petition and while filing of the such petition, either on medical ground or on merits. this order shall not come in his way.
The petition stands disposed of.
