(ORAL) Learned counsel for the petitioner argues that an FIR No.31 dated 20.03.2015 was registered wherein the petitioner was named and after the investigation, the petitioner was found innocent and no challan has been submitted against him, though, the said challan is yet to be considered by the Competent Court of Law. Learned counsel for the petitioner further argues that as the petitioner wanted to visit abroad, he had applied for issuance of Police Clearance Certificate vide application

-2dated 05.10.2019, but due to the pendency of the said FIR, the Police Clearance Certificate is being withheld. Learned counsel for the petitioner submits that no order has been passed on the application dated 05.10.2019 submitted by the petitioner seeking Police Clearance Certificate so far. Learned counsel for the petitioner further submits that in respect of the said grievance, petitioner has already submitted a representation dated 09.03.2021 (Annexure P-4) to the Senior Superintendent of Police (Rural), Jagraon, District Ludhiana, which is still pending consideration with the said authority and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No.2 to decide the said representation by passing an appropriate speaking order.

Notice of motion.

Mr. Sandeep Singh Deol, Deputy Advocate General, Punjab, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition accepts notice on behalf of respondent-State.

Learned State counsel raises no objection with regard to prayer of the petitioner for deciding the representation dated 09.03.2021 (Annexure P-4) by respondent No.2 in a time bound manner by passing an appropriate speaking order.

In view of the above, without expressing any opinion on the merits of the case or the claim being made by the petitioner in representation dated 09.03.2021 (Annexure P-4), respondent No.2 is directed to decide the representation dated 09.03.2021 (Annexure P-4) by

-3passing a speaking order within a period of eight weeks from the date of receipt of a copy of this order.

Present writ petition stands disposed of.
