ARVIND SINGH SANGWAN, J. (Oral) Prayer in this petition is for grant of regular bail to the petitioner under Section 439 of the Code of Criminal Procedure in FIR No.18 dated 13.3.2019 for offence punishable under Sections 323, 324, 326, 341, 506, 148, 149 IPC, registered at Police Station Qadian, District Gurdaspur.

Counsel for the petitioner submits that the petitioner is in custody since 15.5.2019. The challan stands presented and the petitioner is not involved in any other case. One of the co-accused of the petitioner, namely, Amandeep Singh has also been granted the regular bail by the trial Court. Counsel for the petitioner further submits that other co-accused, namely, Gurjant Singh, Bablu and Sukhchain have already been granted the concession of anticipatory bail vide order dated 30.5.2019 in CRM-20023-2019.

CRM-M-28577 of 2019 -2Learned State counsel on instructions from ASI Ravinder Singh has not disputed the factual position and submits that the challan stands presented.

Without commenting anything on merits of the case, considering the fact that the offences are triable by the Court of Magistrate and the trial will take some time and the challan stands presented, this petition is allowed and the petitioner is directed to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Illaqa Magistrate, concerned.

However, it will be open for the prosecution to apply for cancellation of bail of the petitioner, in case he is found involved in any other case or misusing the concession of bail, in any manner.
