IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 17359 of 2015 Date of decision: 21.08.2015 Rana Yashpal Singh ....Petitioner(s)

Versus

State of Punjab and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Manu K. Bhandari, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) Counsel for the petitioner has restricted his prayer to the decision of the demand notice dated 12.01.2015 (Annexure P-7) within a stipulated time frame.

The petitioner's case is that on account of conviction by the Special Judge, Bathinda on 29.11.2003, dismissal order was passed on 17.10.2008. The petitioner's appeal was allowed by this Court on 23.01.2014 (Annexure P-5) and the said conviction was set aside. Petitioner made a request for payments and dues and other benefits on 27.10.2014 and thereafter served a demand notice on 12.01.2015. The same was followed up by the reminder dated 30.04.2015 (Annexure P-8), but of no avail. Keeping in view the limited prayer, it is not necessary to call upon the State to file reply.

Accordingly, the present writ petition is disposed of with a direction to respondent no. 2 to look into the above representation/demand notice and take a decision on the same within a period of 2 months from the date of receipt of certified copy of the order. In case the order is not adverse

-2to the petitioner, the necessary benefit be given within a period of two months thereafter. Needless to say, if the adverse order is to be passed, it should contain reasons so that the petitioner can get liberty to challenge the same.
