G.S.SANDHAWALIA, J. (Oral) Challenge in the present writ petition is to the cancellation of allotment of House No. T-4/193, which was allotted to the petitioner on 30.04.2015 (Annexure P-1).
Counsel for the petitioner has submitted that due to the pendency of CWP No. 26481 of 2014, the petitioner be allowed to live in the said house.
Admittedly, the petitioner has already superannuated on 28.02.2015. It is further the conceded case of the petitioner that this retirement is also after seeking the benefit of extension. It is the case of the petitioner that in the writ petition, he is seeking the benefit of the additional age of retirement on account of his handicap. Once the petitioner has reached the age of superannuation, the right as such to retain the government accommodation does not arise. In such circumstances, if the respondents are taking any action to evict the petitioner on his reaching the age of superannuation, no interference is permissible in the same. In case the petitioner has any claim on account of
-2his right as a handicap person, it is open to him to file an appropriate application in the above mentioned case.
With the above said observations, the present writ petition is dismissed.
